We hope that you enjoy using our site. We’ve prepared these Terms of Service to help you better understand and feel more confident about buying products on our site. We have tried to keep this page as short as we legally can. However, the full-text wording is important and legally binding.

But, for the purposes of this Terms of Service, it’s just easier if we refer to ourselves as “we”.

Buying

We would always advise our customers to obtain a sample of their chosen fabric to ensure they are 100% happy with the item before ordering. Soft Options Shop cannot be held responsible for any customer’s choice of fabric once it has been ordered as each order is custom-made. We would also like you to bear in mind colours can change in different lights and at different times of the day.

We would like to kindly ask before ordering that you make sure the product chosen is suitable for the chosen purpose or use. We are unable to accept any liability arising in respect of any loss, damage, size or deterioration in the condition of any goods sold caused by usage, shrinkage, cleaning process, atmospheric condition or assembly, make-up, installation or general application. We cannot be held responsible for any third-party tradesmen.

Fabrics

Items from time to time may be out of stock. If for any reason your order cannot be fulfilled due to this we will contact you at the earliest opportunity after receiving your order.
We cannot be held responsible for delays beyond our control and will not be responsible for compensating you for any consequential loss, which you may suffer if we do not supply goods in the originally anticipated time scale. Delivery dates can often change and although we will always do our utmost to advise you immediately of any changes, anticipated delivery dates are not always communicated to us straight away.

.Minimum orders are usually one metre of fabric unless the fabric is sold as a remnant then the meterage will be shown on each product.

.No goods can be released to customers until payment has been received in full.

.No orders shall be accepted from any persons under the age of 16.

.All products displayed on this website are subject to availability.

.No statement on this website shall be deemed to affect the statutory rights of a consumer which cannot be excluded or restricted by Law.

.All prices displayed on our website are inclusive of VAT at the current rate of 20%. Prices do not include delivery charges unless otherwise stated.

Samples

Fabric swatches/samples will be sent by post. We would ask that you allow up to 10 working days to receive them. We do our utmost to ensure that our images are a close representation of our products, screen colours can differ from monitor to monitor and may often not be a true representation of the product. Shades and colours can sometimes vary slightly between samples and batches, so if the colour match is critical, please ask for a stock cutting of the current batch when placing your order.

Samples can vary in size. Often a small 8cm x 8cm cutting will be sent out to you but larger samples are available if the fabric has a large pattern on it. For larger samples please call us on 01429 263337 where prices are on application.

Delivery

All delivery charges are quoted at checkout. For small items we use ………..
For larger orders, mainland UK delivery is normally by the next-day carrier. This will usually be ……
Delivery charges apply to UK mainland only. For any deliveries outside the UK mainland and Northern Island, please contact us before placing your order. For deliveries outside the UK mainland, we will contact you immediately to advise of any additional charges. If you do not approve additional delivery charges we will issue you with a full refund.

We can only send orders to one address. If you require the part of your order to be sent to a different address, please order those items separately.

Approximate delivery times in the UK mainland are quoted within the product information but please allow up to 5 working days for delivery. If you are working to a deadline, Saturday deliveries and ‘before 9:30 am’ or ‘before 12-noon’ services can be provided at additional cost, please let us know when placing your order. Often express deliveries can be arranged for an additional fee

Soft Options Shop cannot be held responsible for delayed deliveries caused by our courier networks or adverse weather conditions.

A signature will be required to take delivery of your goods

IMPORTANT - Please check all packaging for damage upon delivery. Damaged parcels must be signed for as damaged. Any damage that has occurred in transit that has been signed for as ‘received in good condition cannot be compensated.

Caring for fabrics

We would advise our fabrics to be hand washed only if in need of washing. Do not use the washing machine or any type of cleaning chemicals as this may damage the fabric. Further advice for fabric care can be requested. If needed we can ask our suppliers for advice.

Data Protection and Privacy Policy

Soft Options Shop is the sole owner of the information collected on this site.
We are committed to safeguarding the privacy of our website, visitors and service users.
We will not share or rent this information to others in ways different from what is disclosed in this
statement. On registering or placing an order on the Soft Options .com website we gather a little about you to help us provide a better service to you now and in the future.

Here at Soft Options Shop, we will only request the information to process your order quickly and efficiently. Once your order has been processed we do not keep, rent, share or give any of your details to anyone else.

We do not store credit card details nor do we share customer details with any 3rd parties.

Receipt of Goods

We would advise that customers check all goods for any damage upon receipt as Soft Options Shop cannot be held responsible for any goods that have been damaged in transit once the goods have been signed for. Please make sure all items are checked before signing for them. If a friend or neighbour is signing for the goods we would advise that you ask them to check all the goods for any damage before signing the delivery. Please check for faults or defects on fabrics before cutting. Please check the fabric is the correct width and if you already have a sample make sure the fabric is the correct colour. We cannot be held responsible for any miss-measures.

Website Content & Product Information

Here at Soft Options Shop, we take reasonable care to ensure that all details, descriptions and prices of products on the website are correct at the time when the relevant information is uploaded onto our system. Although we aim to keep the website as up-to-date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy. Please note that in the event that an error is identified non-acceptance of an order by us may occur, subject to your statutory rights.

We cannot be held responsible for any inaccuracies and would advise that customers check the product information prior to ordering, as this is being constantly updated and amended.

You recognise and agree that all copyright, database rights, trademarks and all other intellectual property rights in material and/or content of this website are owned by Soft Options Shop or our licensors and shall remain at all times vested in us or our licensors as expressly authorised by us or our licensors.

Risk & Title

Once ordered products have been delivered to you, all titles and ownership will pass to you. Delivered products will be held at your own risk and we will not be liable for them.

Entire Agreement

You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation save as far as the same has expressly been made a term of these terms and conditions and you agree that you shall have no remedy in respect of any representation.

Severance

In any provision contained in these terms and conditions is considered by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other terms and conditions which shall remain in full force and effect.

Assignment

You may not assign or subcontract any of your rights or obligations under these terms and conditions or any related order for products to any third party without by these terms and conditions shall not be deemed to be our written consent. We reserve the right to transfer, assign or subcontract any of our rights or obligations under these terms and conditions or any related contract to any third party.

Waiver

A failure by us to exercise or enforce any right conferred upon us by these terms and conditions shall not be deemed to be a waiver of such right or operate so as to bar the exercise or enforcement thereof at any subsequent times or times.

General

The laws of England and Wales govern these Conditions and all disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
